Arricchimento indiretto e titolo gratuito: la Cassazione tra continuità e assestamento sistematico

La sentenza in epigrafe affronta il tema dell’ammissibilità dell’azione di ingiustificato arricchimento ex art. 2041 c.c. nelle ipotesi di arricchimento indiretto.  Nel solco di un orientamento ormai consolidato, la Corte ribadisce che l’azione è esperibile nei confronti del terzo arricchito quando la locupletazione sia avvenuta a titolo gratuito, valorizzando la funzione equitativa del rimedio e il richiamo analogico all’art. 2038 c.c., nonché ritenendo integrato il requisito della sussidiarietà. La pronuncia, sia pur confermativa, si inserisce in un quadro interpretativo che tende a valorizzare l’effettività della tutela, lasciando aperti spazi di riflessione sul coordinamento tra tale esigenza e i limiti strutturali dell’azione.

The decision under review addresses the admissibility of claims for unjust enrichment under Article 2041 of the Italian Civil Code in cases of indirect enrichment. In line with a now well-established line of authority, the Court confirms that such claims may be brought against the third-party who has benefited from the enrichment where the latter has occurred without consideration. In doing so, it emphasizes the equitable nature of the remedy, endorses an analogical application of Article 2038 of the Civil Code, and finds that the requirement of subsidiarity is satisfied. Although essentially confirmatory, the ruling fits within a broader interpretative trend aimed at enhancing the effectiveness of legal protection, while at the same time leaving open significant questions as to how this objective can be reconciled with the structural limits inherent in the action.
